Gateway determination was issued back in December 2021…so what’s new in the adopted LEP amendment?
- Employment zone reforms have now been incorporated, updating land use zones and permissibility.
- Residential uses are prohibited in all Employment zones.
- Shop-top housing is permitted in:
- MU1( Mixed Use) zones if 17% of GFA is non-residential and a Design Competition is undertaken
- E1 (Local Centre) zones.
- Extension of the Chatswood CBD- to Ashley Street to the north, Mowbray Road to the south.
- Significant increases to height and FSR in some parts of Chatswood CBD and St. Leonards.
- Introduction of sun access planes to protect sunlight to certain public spaces.
- Affordable housing contributions apply at either 4%, 7% (Artarmon) or 10% (Chatswood, North Willoughby, Northbridge and Castlecrag). A savings provision applies to negotiated planning proposals which remain at 4%. Sites receiving no uplift in height or FSR remain at 4%.
- Changes to Height and FSR in local centres (Artarmon, North Willoughby, Naremburn, Castlecrag, Northbridge, Penshurst St, Willoughby and Willoughby South)
We understand the Draft DCP is being amended in relation to flood planning and landscaping, and will follow in the coming weeks. We eagerly await the finalised DCP parking rates which will be key to the feasibility of future development.
